Construction Expert. CONTRACT ADVICE AND DRAFTING: • Drafted, negotiated and advised on 4 UK onshore wind farms based on Engineer, Procure and Construct contracts and separate Operation, Maintenance and Service Contracts with combined value of approx. £120m. • Drafted and negotiated amendments to IChemE Red and Green books for pharmaceutical works, value approx. £50m. • Drafted amendments to JCT standard form for new build and refurbishment works to dairy in 5 phases over 3 years, value approx. £15m. • Advised and drafted professional appointments and turnkey contract in relation to East London Waste Authority project, acting on behalf of the joint venture and including negotiations of take-over and acceptance procedures, value approx. £750m. • Acting on behalf of Kraft Foods for numerous contracts relating to specialist machine purchase contracts and plant refurbishments including new plant and machinery, requiring advice and drafting of amendments to MF/1 and ACE form of appointment. DISPUTE RESOLUTION AND STRATEGY: • Acting on behalf of Employer in relation to claim by turnkey contractor to recover £4.5m withheld in relation to delay and performance damages. Advising through contract dispute resolution procedure and commencement of ICC arbitration and subsequent mediation. • Acting on behalf of the liquidators for loss and expense claim relating to land reclamation scheme, where Claimant was a ground works contractor and Respondent, a local authority. Supervision of arbitration and negotiation of contingent fee arrangement with client. Conduct of mediation and settlement negotiations and agreement.
