ESTATE LITIGATION:* Representation for Executors whose fiduciary role is being challenged, whether in a request for an account of their administration or a challenge to the testamentary writing from which they derive their authority in a will contest.* Challenging fiduciaries who have neglected their duties or assumed roles they are not entitled to, including petitioning for the account of and subsequent removal of fiduciaries who have failed to administer an estate in a timely, statutory manner or who have misappropriated assets including attempting to live rent-free in the house of the decedent.* Assisting with the compilation and production of complicated multi-year accountings with administrators and executors.* Mediation and settlement negotiation to successfully end protracted litigation between intractable beneficiaries and fiduciaries.
