Arlene has concentrated her practice in complex commercial litigation, including products liability, toxic tort, and consumer protection class actions. She has litigated the propriety of class certification, both mandatory and voluntary, in federal and state courts throughout the United States, as well as counseling clients regarding the use of class action settlements to facilitate global resolution of a client\'s liabilities. As counsel for various manufacturers of building products, she represents a major manufacturer of roofing shingles in connection with the administration of a class action settlement; she took a leading role in the defense of a wave of class actions complaining of alleged dangers of asbestos-contaminated vermiculite; and she developed the arguments challenging class certification in an environmental class action involving one of the country’s largest cement plants. She was the co-reporter for the Mass Tort Litigation Manual of the American College of Trial Lawyers. Arlene\'s practice includes other business tort litigation. For example, she represents the Court-appointed Receiver in connection with the Receiver\'s efforts to recover investors\' assets misappropriated by the perpetrator of a ponzi-scheme. She has represented various operators of hedge funds who have been sued for defamation in connection with their reports about various publicly-traded companies or their posts on internet websites. In connection therewith, she was co-counsel for the successful appellant in the case that she established the standard in California for unmasking an internet poster.
