EXPERIENCED REAL ESTATE TRANSACTIONAL ATTORNEYFor over 35 years, Andy Folkerth’s clients have trusted him to represent them in various real estate, lending, and development transactions. His clients also rely upon him for day-to-day counsel on how best to structure transactions and to mitigate risk, avoid pitfalls and avoid litigation. Andy is often seen as a “member of the team” as he builds long, multi-year relationships with his clients.LENDERS — SUCCESSFULLY COMPLETING LOAN TRANSACTIONSAndy works closely with banks and other financial institutions of all sizes to efficiently and effectively close their loan transactions. He works within each client’s lending procedures and processes. He has completed loans of all sizes and complexities, including construction loans, acquisition loans, ground leasehold financings, mezzanine financings, and loan syndications and participations.LENDERS & DEVELOPERS — AFFORDABLE HOUSING TRANSACTIONSAndy has extensive experience in representing lenders in Low Income Housing Tax Credit (LIHTC) transactions and other related affordable housing financings. He also assists developers and owners in closing complex affordable housing deals.INVESTORS — ACQUISITION & SALE OF PROPERTY Andy represents both buyers and sellers in various types of commercial real estate, including office, retail, warehouse, resort, and hotel properties. He adds value throughout the process, from drafting the letter of intent, negotiating deal terms in purchase and sale agreements, and conducting due diligence all the way through the final closing of the transaction. DEVELOPERS — DEVELOPMENT PROJECTS He has worked on projects such as office buildings, hotel and mountain resort projects, land development projects, shopping centers, master-planned communities, residential subdivisions, and golf courses, among others.OTHER COUNSEL — LOCAL COUNSEL WORK Andy also provides local counsel support to attorneys outside of Colorado, whether they are looking for a team member in a sophisticated multistate transaction or in need of a Colorado legal opinion. Andy is currently the co-chair of Holland & Hart’s opinion letter committee.
