Trial Experience Representation of opt-out Plaintiff healthcare companies in In reSuboxone MDL alleging a fraudulent and anti-competitive “producthop” scheme. Mr. Sacher presented Plaintiffs’ expert testimony andcross-examined defendant’s corporate representative at statute oflimitations trial. Plaintiffs prevailed, securing an $85 millionsettlement days before the merits trial, which is one of the highest“opt out” pharmaceutical drug recovery settlements on record. Representation of opt-out Plaintiff Humana in an off-labelmarketing case alleging fraudulent conduct in connection withoncology medications. Mr. Sacher was trial counsel during the 5-week trial in Kentucky State Court and was responsible for allaspects of trial strategy. Mr. Sacher presented multiple experts anda lay witness during Plaintiff’s case in chief. In addition, he wasresponsible for the cross-examination of several of Defendants’expert witnesses. Representation of Plaintiffs including a State Pension Fund In reGSE Bonds Antitrust Litigation, 19-cv-01794 (S.D.N.Y.)(JSR)alleging antitrust activity in bond pricing by some of the world’slargest banks. Mr. Sacher designed the cross-examination strategyfor the case. Following the first deposition of a Defendant, LoweyDannenberg was able to secure settlements totaling $386.5 million.
